Personal Statement:
Matthew Berkowitz joined Carr Maloney as an associate in 2010. His practice focuses on Complex Litigation, General Liability, Professional Liability, Employment and Labor Law, Appellate Practice, and Insurance Coverage. Matt regularly represents national restaurant and retail chains in complex negligence actions and defends attorneys and other professionals accused of malpractice. He has handled class action lawsuits and has experience at the trial and appellate levels.
Before joining Carr Maloney, Matt was an associate at a mid-sized firm in the District of Columbia. There, he represented insurance companies in complex coverage disputes involving toxic tort and environmental matters, and other clients in disputes involving contracts, defamation, employment law, real property, and medical malpractice. He also successfully defended an architect who was sued for indemnity, contribution, professional negligence, and breach of contract. The Court held that the developer's claims were preempted under the Fair Housing Act and American Disabilities Act. Equal Rights Center v. Niles Bolton Associates, 602 F.3d 597 (4th Cir. 2010), cert. denied, Archstone Multifamily Series I Trust v. Niles Bolton Associates, Inc., 131 S.Ct. 504 (U.S. 2010).
Matt graduated from Thomas Jefferson School of Law, summa cum laude, where he served as the Managing Editor of the Thomas Jefferson Law Review and was a member of the school’s moot court team. Following graduation, Matt served as a law clerk to the Honorable Michael W. Farrell of the DC Court of Appeals.
Matt is the author of Application of the ‘Frequency, Proximity and Regularity’ Test of Causation to Non-Products Claims for Asbestos-Related Personal Injuries, Mealey’s Litigation Report Asbestos (March 17, 2010), and co-author of Employment Practices Liability Insurance & The Perfect Storm, Current Developments in Insurance Law 2010 (December 28, 2009), and Keep Interests in Mind in Court, Business Insurance (October 11, 2010).
