Personal Statement:
Kelly is a member of the firm. She focuses her practice on Products Liability, Insurance Coverage, and Employment and Labor Law. Kelly has first-chaired dozens of jury and non-jury trials in Maryland, Virginia, and the District of Columbia. She also has argued before the Maryland Court of Special Appeals. Kelly brings to her clients the advantage of having represented both plaintiffs and defendants.
In products-liability matters, Kelly has defended a wide variety of manufacturers and distributors in federal and state courts in suits against product liability claims. She is an active member of the DRI’s Product Liability section. Kelly also has written several articles relating to product liability claims, including Managing the Risks of a Defective Product, which appeared in the Occupational Health & Safety magazine. In the area of insurance coverage, Kelly has advised insurers about an array of matters, and defended insurers in disputes in federal and state courts. Kelly has litigated matters involving property coverage, life insurance coverage, additional insured disputes, and other areas of coverage.
As a member of the firm’s Employment and Labor Law group, Kelly has defended employers against claims of employment discrimination, retaliation, wrongful discharge, breach of contract and defamation.
Kelly has successfully tried professional liability cases brought against realtors, insurance agents, and attorneys. She is the Chair of the Virginia Association of Defense Attorneys Professional Liability Section.
Based on her experience, Kelly has developed considerable expertise in civil procedure. For example, based on one of her cases, Kelly recently wrote The Right to a Non-Suit in Virginia Is Not Absolute, an article that provides the defense perspective on a procedural tool favored by plaintiffs. Before entering private practice, Kelly was the law clerk to the Honorable Patricia A. Broderick of the Superior Court of the District of Columbia. During law school, Kelly served as a student attorney in the Criminal Justice Clinic. Kelly represented criminal defendants and prosecuted criminal matters in the Maryland District Court for Montgomery County.
