Personal Statement:
Kevin Murphy is a director and officer of the firm. He litigates and counsels in matters involving professional liability, estates and trusts, business and contract disputes, entity formation, and serious property loss and personal injury litigation. Kevin also works on strategic management of claims and risk for insurers and self-insured entities. He has received an AV (highest) rating from Martindale Hubbell Law Directory.
Kevin has been lead counsel in dozens of jury and non-jury trials, as well as in arbitrations. Many of these have resulted in reported appellate decisions—several setting important legal precedents, including: Doe v. Maskell, 679 A.2d 1087 (Md. 1996), cert. denied, 117 S. Ct. 770 (1997); Murphy v. Merzbacher, 697 A.2d 861 (Md. 1997); Beard v. Goodyear Tire and Rubber Co., 587 A.2d 195 (D.C. 1991); Travelers Indemnity Co. v. INA, 519 A.2d 760 (Md. 1987); Kelly v. Theodore Cardinal McCarrick, Catholic Archbishop of Washington, and His Successors in Office, a Corporation Sole, 841 A.2d 869 (Md. App. 2004); and Haltiwanger v. Unisys Corp, 949 F.Supp.898 (D.D.C. 1996).
Kevin is the author of several articles in the fields of professional liability, product liability, technology and insurance law, and has been a frequent lecturer on those topics. From 2000 to 2005, Kevin contributed to The Flyer, a quarterly publication of the Federation of Defense and Corporate Counsel, a regular column on federal legislation regarding product liability and professional liability issues. He co-authored a journal article entitled "The Application of Daubert or Frye Analysis to Expert Testimony in the Soft Sciences," published by The Federation of Insurance and Corporate Counsel in The Quarterly, 1997. Kevin chaired a panel presentation on technology liability issues at the 2000 annual conference of The Professional Liability Underwriting Society. Kevin also presented at the 2002 Loss Prevention Convention of the National Retail Federation on "Protecting Intellectual Property Assets: Brand Image, Patents, Trademarks & Licenses." Frequently, Kevin has made industry presentations regarding risk management and litigation issues for accountants, lawyers, doctors and technology professionals.
