Personal Statement:
Paul Maloney, a Member of the firm, concentrates his practice on product liability, professional liability litigation, and commercial litigation. Paul has been a frequent speaker on risk management principles and business practices and has spoken on numerous occasions for the District of Columbia Bar on topics such as the D.C. Superior Court Rules and litigation tactics. He filed an amicus brief in the Supreme Court in Medtronic, Inc. v. Lohr, 518 U.S. 470 (1996), the leading medical device case on the issue of federal preemption. Paul, along with William Carter, submitted an amicus brief on behalf of Medmarc in the Riegel v. Medtronic case. This is the leading case on preemption for pre-market approved devices. In February 2008, the Supreme Court decided 8 to 1 in favor of Medtronic, thereby barring most common law claims that could be brought by a plaintiff injured by a pre-market approved device.
Paul is a frequent speaker and contributing author on product liability matters. He has written on products liability legislation pending before Congress and on the product misuse defense available in products liability litigation. He was Medmarc Lawyer of the Year in 2000. Paul spoke at a conference on February 26, 2008 before SecurePharma on the topic of “The Crossroads of Pharmaceutical Pedigree and Product Liability Litigation”.
Before joining the firm in 1984, Paul served as a law clerk to the Hon. Joseph M. Hannon, Superior Court Judge for the District of Columbia. Following his clerkship, Paul served as an Assistant State’s Attorney for Prince George’s County, Maryland. In 1987, he was appointed Associate Independent Counsel to James C. McKay in the Lynn Nofziger Investigation.
