Personal Statement:
Tom McCally is an equity Member and Officer of the Firm. Tom heads the
Employment and Labor Law Practice. He is an experienced trial attorney
representing clients in Federal and State courts throughout the mid-Atlantic
region. In addition, he regularly practices before the EEOC and state/local
EEO agencies. Tom’s other areas of specialization are commercial
litigation, business law, directors and officers liability, complex litigation,
civil rights, and non-profit/religious institutions practice.
The Firm’s Employment and Labor Law attorneys represent employers, large and small, in all aspects of employment and labor law. This includes litigation, counseling and training. Tom has served as lead counsel in scores of trials involving claims of employment discrimination, sexual harassment, retaliation, ERISA, whistle-blower, wrongful discharge and unfair labor practices in State and Federal courts throughout the mid-Atlantic region. In addition to litigation, Tom regularly counsels and guides employers through the myriad of federal, state and local employment practices. Tom serves as outside general counsel to a number of for-profit and not-for- profit organizations. As part of its training programs, the Firm’s Employment and Labor Law group creates, revises and counsels employers on various employment practices and compliance issues. In addition to lecturing, Tom provides training to employers throughout the mid-Atlantic in all aspects of employment and labor law.
Tom also regularly represents corporations, and other businesses, in all types of commercial and business law disputes. This representation includes litigating cases involving violations of non-compete/non-solicitation agreements, misappropriation of trade secrets/proprietary information, business disputes and dissolution, breach of fiduciary duty and all types of breach of contract claims. In addition to litigating, Tom drafts, negotiates and enforces commercial contracts and employment agreements for businesses and individuals alike.
Another component of Tom’s practice is representation of not-for-profit and religious institutions/charitable organizations. Included are trade associations, professional associations, religious institutions, charitable organizations and other non-profit entities. In addition to representing not-for-profit clients in litigation, Tom counsels these clients in a broad array of employment and business related matters, remaining conscientious of their unique and special needs
On the labor law front, the Firm’s attorneys have significant experience representing both management and labor organizations. Tom’s experience in labor law includes collective bargaining agreement disputes, arbitration of grievances and litigation involving unfair labor practices.
The remainder of Tom’s practice is dedicated to complex litigation matters of all types. This includes claims of civil rights violations, sexual/psychological abuse, wrongful death, catastrophic injury and mass torts.
Before entering private practice, Tom served as law clerk to the Honorable Richard B. Latham, Circuit Court for Montgomery County, Maryland. Over the years, Tom has served in various capacities for national, state and local Bar associations. Tom served as co-Chair of the Civil Jury Instructions Committee of the Bar Association of the District of Columbia (1993 – 1998), which resulted in the publication of the Standardized Civil Jury Instructions for the District of Columbia, 1998 revised edition. Tom’s service to the Bar has been recognized on many occasions including receiving the Outstanding Achievement Award from the Bar Association of the District of Columbia, Young Lawyer’s Section, in June 1996.
Tom was lead counsel in cases that have resulted in appellate decisions, including: EEOC v. National Children's Center, Inc.; Thomas v. Technical Resources Inc.; Potts v. District of Columbia; W.M. Schlosser v. Maryland Drywall Company, Inc., Thomas v. American Society of Civil Engineers; Millard v. Boys Home of Baltimore; Brent v. RS Information Systems, Inc., From the Heart v. African Methodist Episcopal Zion Church, et.al., and Wyvill v. Archdiocese of Washington.
