As mentioned in the first series of this webinar, the PERM Labor Certification Process is a multi-step procedure that a U.S. employer must follow to sponsor an immigrant worker for lawful permanent residence. When a U.S. employer files an ETA Form 9089, the Department of Labor can approve, deny, or audit your PERM. If your PERM is approved, the U.S. employer must then proceed to the second major step of the process, which is successfully filing Form I-140 with USCIS. While an employer may think that it survived the most difficult part of the process by having their PERM approved, an employer still needs to be careful and avoid making any untimely or careless mistakes during this second stage that could jeopardize their petition and result in a denial.
In filing a I-140 visa petition, a U.S. employer must carefully identify (1) the type of employment-based classification the employer is asking USCIS to grant to the foreign worker; (2) accurate information about the company, which includes the type of business, net annual income, information obtained in the labor certification process; (3) provide the most up-to-date information about the foreign worker, including the worker’s I-94 number and the foreign worker’s prior and current status; (4) and provide information about the proposed employment position, including job title, SOC code, job description/duties, and proposed salary. Further, depending on the complexity of the case, it is recommended that an employer submit supporting documents, such as a job offer letter or profit/loss statements, which can strategically enhance the likelihood of approval.
