Kenneth Stallard is a Member at Carr Maloney with over 25 years of experience in civil litigation, including professional malpractice, construction defects, fire loss, medical devices, products liability, lead paint exposure, radon gas exposure, insurance coverage, contract disputes, and trust and estates matters. Ken maintains constant contact with his clients, and believes that only well informed clients can make well informed decisions.
Ken regularly represents architects, engineers, general contractors and sub-contractors in all aspects of construction law, including construction defect litigation, contract litigation, fire loss claims, mediation, and arbitration. Ken has also served as outside general counsel to general contractors. His recent work includes:
- Representing a general contractor on claims involving envelope and structural issues at a twelve story hotel at the Prince George’s County, Maryland’s National Harbor Complex;
- Representing an engineering design firm in a lawsuit involving multiple design and construction issues at Hampshire County, West Virginia’s Wellness and Fitness Center;
- Representing an engineering design firm in a lawsuit involving design and construction issues at a high rise medical office building in West Virginia.
Ken received national attention for a 2015 lawsuit in which he successfully defended the Chesapeake Region Volleyball Association of U.S.A. Volleyball in a suit filed by a player dissatisfied with her playing time. The case was featured on ABC’s Good Morning America, NBC’s Today Show, CBS This Morning, and Fox News’ Fox & Friends. Print coverage of the case appeared in The Washington Post, Washington Times, Chicago Sun-Times, Daily Mail (UK), Florida Times-Union, Forbes, Kansas City Star, Miami Herald, New York Daily News, San Diego Union-Tribune, St. Louis Post-Dispatch, State Journal-Register, U.S. News and World Report, and Yahoo! News.
Ken has produced great results for his clients, including a favorable ruling for a boiler repair company in the United States Court of Appeals for the Fourth Circuit in Artis v. Bildon Company. In 2016, he successfully appeal an arbitration decision in Equitas Disability Advocates, LLC v. Feigenbaum, et al. in the United States Court of Appeals for the D.C. Circuit. He successfully represented the child of the former Chief Judge of the District of Columbia Court of Appeals in the case of In Re: The Estate of Dorothy O’Reilly, a case that was heard in the District of Columbia Court of Appeals.
Ken grew up in the coal country of southwestern Virginia before receiving a Bachelor of Arts degree from Virginia Tech and a Law Degree from Washington and Lee University. He began his career in Raleigh County (WV) and became the Secretary/Treasurer for the Raleigh County Bar Association in 1988 and a Member of the West Virginia State Bar Association’s Employment Law Committee in 1989.
Ken has extensive history with the D.C. Defense Lawyers’ Association, serving as President from 2007-2008 and as a Member of the Board of Directors from 2008-2012. Ken is also active in The Barristers of Washington, DC, an exclusive, non-profit organization dedicated to maintaining high standards of legal ethics among its members. He was named a Member of the Executive Committee in 2003 and elected President from 2011-2012. A 2012 Fellow of the American Bar, Ken is also a former Board Member at the Council for Court Excellence and Affiliate Member of the Potomac Valley Chapter of the American Institute of Architects.
Ken is also a member of the Bar Association of the District of Columbia, District of Columbia Bar, West Virginia State Bar, Virginia State Bar, Virginia Association of Defense Attorneys, and the Defense Research Institute.
