Carr Maloney is pleased to welcome Andrew J. Morris as a new member in the firm. His practice focuses on commercial litigation and government investigations with an emphasis on high-stakes disputes involving financial reporting, professional liability, securities fraud, and corporate governance. Morris joins Carr Maloney from the Washington, D.C. office of Mayer Brown LLP, where he practiced for almost 15 years. There, his primary clients were major public corporations, national accounting firms, and individual officers and directors.
Morris has represented clients in a wide variety of civil litigation, including class actions, and multi-district matters, as well as in enforcement actions, parallel proceedings, and internal investigations. He has tried cases before judges, juries and arbitrators. He also has counseled clients on a wide range of issues including risk management, disclosure obligations and fiduciary duties.

On April 15, 2009, Mike Sepanik will present “Leveling the Playing Field: Effective Cross-Examination of Engineering Experts at Trial” at DRI’s National Products Liability Seminar in San Diego, California. Carr Maloney P.C. is pleased to announce that Ali Beydoun has been promoted to the position of Senior Counsel in the firm. Ali has been an associate with the firm since 2003 and he will continue his work in Toxic and Mass Tort as well as Employment and Complex Litigation.

Carr Maloney hosted a book drive in Spring 2009 on behalf of Turning the Page, a local non-profit group that supports the DC Public Schools. The firm collected books of all genres and for all ages. Turning the Page will host a book sale of all the donated books to benefit the schools

Larry Carr will receive the Bar Association of the District of Columbia’s President’s Special Recognition Award at the annual Bar Association Banquet on December 6th to recognize his many years of valuable service to the Bar. Larry is a past President of the Bar Association and a Bar Fellow.

On November 13, 2008 Dennis Quinn and Elizabeth Francis, along with Julia Porter, Senior Assistant Bar Counsel, presented a seminar entitled “Avoiding Legal Malpractice and Bar Complaints.” The course offered daily practice and risk management techniques to reduce the possibility of bar complaints and legal malpractice claims. The course was sponsored by the D.C. Bar Courts, Lawyers and the Administration of Section and the Litigation Section. The program ran from 6 to 9:15 p.m. at the D.C. Bar Conference Center at 1250 H Street NW.

In December, associate Sarah Godfrey spoke at a seminar titled "Medical Records Law in the District of Columbia." The seminar was designed to update health care providers and other professionals (including medical records custodians, hospital administrators, compliance directors, and attorneys) on HIPAA privacy and security rules, how to respond to subpoenas, special medical records challenges related to minors or other sensitive health issues, and avoiding litigation and penalties for privacy violations. The seminar took place on December 5, 2008 at the Embassy Suites Hotel in Washington DC.

Tom McCally participated in a panel discussion on behalf of the Association of Legal Administrators titled Diversity -- Yesterday, Today and Tomorrow. Tom specifically addressed the legal pitfalls of implementing a diversity program. The ALA recently recognized this presentation with a first place award at the ALA Annual Meeting in Seattle for outstanding chapter programming.

On May 30, 2008, a federal court in Washington, D.C., approved a settlement negotiated by Ali Beydoun of Carr Maloney P.C., that dismissed the firm’s client, a magazine publisher, from a lawsuit filed by the Humane Society of the United States. In the case, which involved important First Amendment issues, the Humane Society accused the publisher of violating District of Columbia consumer protection laws by encouraging prohibited conduct through the sale of its magazine. Carr Maloney associate Ali A. Beydoun has been instrumental in advocating on behalf of the indigenous people of the Chagos Archipelago before the US and UK governments. They were forcibly removed from their homeland more than 40 years ago to make way for a military base. On March 27, 2008, the U.S. District Court for the District of Columbia ruled in favor of a restaurant and nightclub owner's insurer holding that the insurer was not required to defend and indemnify the owner in a wrongful death action brought against it because the insurance policy's assault and/or battery exclusion barred coverage. Paul Maloney and William Carter submitted an amicus brief on behalf of Medmarc in the Riegel v. Medtronic case. This is the leading case on preemption for pre-market approved devices. In February, the Supreme Court decided 8 to 1 in favor of Medtronic, thereby barring most common law claims that could be brought by a plaintiff injured by a pre-market approved device.

Thomas L. McCally of the Firm was one of the featured speakers at the Diversity Forum sponsored by the Association of Legal Administrators, Capital Chapter on November 14, 2007. The Diversity Forum addressed the implementation, execution and potential pitfalls of law firm diversity programs. Mr. McCally spoke about the potential legal pitfalls of law firm diversity programs and how to best avoid litigation when implementing such valued and important initiatives. Legal Administrators from firms throughout the Washington Metropolitan area were in attendance.

Dennis J. Quinn was elected to the Executive Committee of the Virginia Association of Defense Attorneys. Mr. Quinn will serve as Secretary for 2008, and move through the other leadership positions before eventually becoming VADA President in 2011.
