Peter Glaws is a Member at Carr Maloney P.C. and has extensive experience as a litigator in federal and state trial and appellate courts, with many reported decisions to his name. Peter’s broad litigation practice includes complex commercial disputes (including professional liability defense), complex construction litigation, corporate disputes, trust and estate litigation, and intellectual property litigation (copyright and trademark infringement cases).

Representing professionals is a key component of Peter’s practice. In that area, Peter regularly represents accountants, lawyers, architects, and other professionals. In Peter’s accountants’ liability practice, he represents international, national, and regional firms in disputes arising out of complex auditing, tax, consulting, and other accounting services. Peter represents law firms of all sizes in disputes, which have included, among other things, underlying patent applications, real estate transactions, white collar criminal defense, and litigation (commercial and civil). Peter also represents professionals before state and national licensing and regulatory bodies such as state bar authorities, boards of accountancy, inspectors general, and federal agencies.

Peter further serves as outside counsel to large and small businesses. In that role, Peter leverages his knowledge of how certain issues can lead to years of protracted litigation and applies that experience in contract negotiation (including drafting or revising professional engagement letters, master service agreements, HIPAA business associate agreements, and other contracts), corporate governance and governing documents, risk management, data loss and cyber liability, subpoena responses, selected tax issues, and other general legal matters. Peter has also counseled numerous professional firms on acquisitions or combinations with other firms.

Before joining Carr Maloney, Peter served as a law clerk in the Office of the Attorney General of Virginia, where he worked on white-collar criminal litigation and analyzed the impact of pending federal legislation on the Commonwealth.

Peter is a graduate of The Catholic University of America, Columbus School of Law, cum laude. At Catholic, Peter served as notes-and-comments editor for the Journal of Law, Philosophy, and Culture and was a member of the Willem C. Vis International Arbitration Moot Court Team. Peter is a graduate of the National Trial Advocacy College at the University of Virginia School of Law and received his undergraduate degree from York College of Pennsylvania, magna cum laude.

Representative Experience

  • Secure summary judgment for national accounting firm on plaintiff’s breach of contract and professional liability claim for tens of millions of dollars in lost revenue and lost profits.
  • Draft and negotiate asset purchase agreement for combination of national accounting firm and small specialty accounting firm.
  • Advise limited liability company in redrafting governing documents for better risk management terms and compliance with certain federal regulations.
  • Successfully brief and argue a case of first impression before the U.S. Court of Appeals for the D.C. Circuit achieving judgment in favor of a defendant client on the applicability of statute of limitation tolling principles to predecessor entities.
  • Represent a national construction firm in defense of liability claims by an employee of a subcontractor and prosecution of contractual indemnity claims against the subcontractor.
  • Draft new client engagement letters for large regional accounting firm.
  • Represent a large accounting firm in a bankruptcy trustee’s investigation of potential claims against a debtor’s insiders and other service providers.
  • Regularly represent professional firms in connection with Bankruptcy Rule 2004 examinations.
  • Achieve judgment in favor of a client on the applicability of the economic loss doctrine to real estate settlement agents in D.C., a case of first impression.
  • Represent a national architectural firm in litigation against a general contractor related to one of the largest redevelopment projects in Washington, D.C.
  • Represent an international telecommunications company in a commercial contract dispute involving provision of satellite communications to oil drillers.
  • Represent a national accounting firm in litigation involving the IRS’ use of transferee tax liability for a large real estate transaction.
  • Defend a large law firm against a post-bankruptcy trustee seeking to hold the firm liable for a former client’s fraud.
  • Counsel national accounting and regional firms on response to breach or potential breach of protected personal information.

Outside The Office

Peter, his wife Shannon, their three children, and Chocolate Lab, Murphy, live in downtown Leesburg, Virginia and are parishioners at St. John the Apostle Catholic Church. Peter grew up in Alexandria, Virginia and both he and Shannon are graduates of Bishop Denis J. O’Connell High School in Arlington. Peter is an avid outdoorsman, conservationist, and does his best to cultivate historic varieties of Virginia apples and other vegetables.
